If you are the party seeking to move, and the other parent objects, you must have a very good reason for the move. A better income may benefit the children. Caring family close by will benefit the children. However, your own whim or a child custody dispute may not be a reason the court will accept.

If you are the non-custodial parent, your inconvenience will be a factor in the court's decision, but only secondary to the best interests of the children. If you can demonstrate that the move will be traumatic for them, or that the schools are better where they currently reside, or that the move will not benefit them, the move may be prohibited by the court. Of course, the children need you, and ensuring your access is important to the court.
