Helping you divide your marital assets and debts

Property division is a part of every divorce. If you and your spouse are divorcing, decisions must be made regarding how to divide your marital assets and debts. For 23 years, the law firm of Michael W. Jackson has assisted clients with the task of dividing up their community property and liabilities. What is Community Property?

Texas is a community property state and anything that you and your spouse have accumulated over the course of your marriage is presumed to be community property. It belongs to you both. Marital assets may include:

  • Real estate, such as a house or condominium, or a farm or ranch
  • Personal property
  • Pension plans or 401(k) plans
  • Stocks and bonds
  • Interest on gifts and inheritance
  • Executive compensation packages
  • A family business

Your marital debts may include:

  • Credit card bills
  • Mortgages
  • Business loans
  • Car loans

What is Separate Property?

Although all of the property possessed by a married couple is presumed to be community property, Texas law recognizes separate property. Separate property includes any asset owned before marriage and anything acquired by gift or inheritance. At the Law Office of Michael W. Jackson, I will help you identify and protect your separate property.

Property Division Services

Although Texas is a community property state, the court does not have to split the assets and debts right down the middle. It can use its discretion to make a disproportionate division if the facts justify it.

In order to help achieve a property division that is fair and reasonable, I sit down with my client and make an inventory of all assets and debts. Full disclosure is very important at this stage. The more information a client provides about their property, the more thorough the final decree will be. Before we try your case, or even begin serious negotiations, we decide how we believe the property should be divided, and I assemble the facts to support my client's position. Having a plan before you go into negotiations saves my clients time and money.
